MINUTES OF THE HAVEN TOWN BOARD MEETING

December 18, 2006

 

The Haven Town Board met at the Haven Town Hall on Monday, December 18, 2006.  The meeting was called to order at 7:00 p.m. by Chairperson Eric Meyer.  Members present:  Eric Meyer, LeRoy Pauley, Keith Hibbard, Dennis Lietha, Ted Prom, Mike Zniewski, David Meyers, and Tammy Schefers. 

 

APPROVAL OF AGENDA

The Bauerly Brothers Busse Pit / Stark Pit is not going to be on the agenda this month, it has been tabled till next notice.  Supervisor LeRoy Pauley made a motion to approve the agenda.  Supervisor Keith Hibbard seconded the motion.  The motion carried.

 

READING OF THE MINUTES

Supervisor LeRoy Pauley made a motion to approve the minutes.  Supervisor Keith Hibbard seconded the motion.  The motion carried. 

 

BUILDING PERMITS

There was one building permit.

 

SHERBURNE COUNTY SHERIFF REPORT

The Deputy Sheriff gave the report for the month of November.  There were a total of 73 incidents.

Supervisor LeRoy Pauley made a motion to pay the outstanding bills.  Supervisor Keith Hibbard seconded the motion.  The motion carried. 

 

OLD BUSINESS

CUP Vesterra, LLC – They are still working with the Railroad on this issue. 

 

Don Nelton –The temporary turnaround at the end of River Haven is usable now and will be finished next year.  The restraining order was removed and the Board could level the piles of dirt for the winter season. 

 

Fire Department – August Meeting - Palmer Fire Hall is getting closer.  Another meeting will be held to talk about this.  We have to vote on this issue.  March Meeting will be the time to put it on the ballot.  A meeting will be on August 29, 2006 at 8:00 p.m. at the Town Hall to talk about this option. September Meeting – The Committee met and tentatively selected parcels of land which might be included in a separate Fire District.  There will be a special meeting held on Tuesday, October 10, 2006 to provide information about a Special Fire District on the South & East Side of Haven Township.  The meeting is at the Haven Township Hall from 4:00 p.m. - 7:00 p.m. At 7:00 p.m. there will be public comments and have an open discussion.  The date to vote on the Fire District will be Tuesday, December 19, 2006 from 3:00 p.m. – 8:00 p.m. at the Haven Township Hall.  October Meeting - The Board talked about how the meeting went.  There were people who don’t want the change in the shaded area on the map and some people who want to be brought into the shaded area.  The Board Members will decide the line of the shaded area at the November Meeting.  November Meeting – The Board talked about the shaded areas on the map.  Supervisor LeRoy Pauley was not able to make the meeting, but e-mailed this to say:  “The following is my position on the fire district and I authorize that it be entered in the official minutes of the November 20, 2006 Haven Township Board Meeting.  From the talk I’ve heard and the calls I have received this is a workable idea provided all the wrinkles get ironed out first.  It seems that diplomacy was not really practiced when it came to including the Sauk Rapids Fire Department in the decisions.  Were they officially asked to attend any meetings?  It would be helpful for electorate to really know how the rates are going to be.  The same, increased, or decreased.  The idea that causes the most discomfort among the people is the fact that something that affects the entire township only allows a certain portion the right to vote.  Have all the ramifications been examined?  Does this need to be tabled and MADE PART OF THE AGENDA FOR THE ANNUAL MEETING?  I apologize for not being at the meeting.  Many of these ideas have probably already been resolved.  Knowing what I know at this time (November 17, 2006) I would like a clearer picture of the entire proposal and consequently would like to see the issues tabled until the parties involved are more satisfied.  I know I have given up my right to vote this evening but the afford mentioned questions deserve examination.”  After discussion on this issue Supervisor Dennis Lietha made a motion to define the lines and adopt and pass the Resolution of the Haven Town Board Calling for a Special Town Election and make Annual Meeting notices. Supervisor Ted Prom seconded the motion.  The motion carried.  The Board talked about having the voting done at the March, 2007 Annual Meeting. Section 14 – Gerry Schefers, Brian Schefers, Andy Schefers, Curt Thering two homes, Carol Packer, Mike Kilian, Kurt Saatzer and Bruce Cater (section 23) gave input and talked with Chairman Eric Meyer stating that they all want to stay with Sauk Rapids Fire Department and be out of the shaded area.  December Meeting – Jeff Skumautz (West Sherwood Shores) had a concern and signatures of neighbors in his area that did not want to change fire districts.  They want to stay with Sauk Rapids Fire Station.  Jeff Skumautz stated this area feels they are stepping into the unknown, why change something that is not broken.  If the Board wants to have this voting at the March Annual Meeting they must establish the boundary lines tonight. Tammy Schefers also brought up that everyone on 32nd Street SE from the river East to the corner of 65th Avenue, also wanted to stay Sauk Rapids Fire District.  These people were at the November Meeting asking the Board to change the line so that they would also be out of the shaded area.  She also questioned why the Board had all these previous meetings if they were not going to take the residents opinions for changing the lines.  The people who really wanted the lines changed in their section (to be out of the New Fire District) had attended every meeting.  After along discussion on this issue, Supervisor Dennis Lietha made a motion to accept the resolution and keep the original lines that were decided upon.  Sections 11,12,13,14, the East half of the SE ¼ of 22,23,24,25,26,27, that part of the South ½ of 32 lying East of the right-of-way of CSAH No. 8, South ½ of 33,34,35 and 36, all in Township 35, Range 30.  Supervisor Keith Hibbard seconded the motion.  The motion passed unanimously.  Supervisor LeRoy Pauley made a motion to have one more public meeting to discuss the reasons why the Board chose to keep the original lines.  It will be sometime in January.  Supervisor Ted Prom seconded the motion.  The motion carried. The next step is, there will be a vote for the qualified voters residing within the shaded areas at the annual election March 13, 2007 to decided if the New Palmer/Clear Lake Fire District will be accepted or if the Township should just stay with Sauk Rapids Fire Department.       

 

Contractors Yard – Kilian Addition - Mr. & Mrs. Peters were at the meeting to discuss their business.  It is a vent cleaning business.  The Peters did not think they were doing anything wrong.  The Peters only have a truck and a trailer parked outside.  Roger & Gloria Plombon were neighbors that attended the meeting stating that they are good neighbors. The Peters had other letters from more neighbors that stated they are fine with the business they are doing and they are good neighbors. Marc Schneider from the County will investigate this issue.  If they do want to pursue a business at their home they must go to the County and talk with the Zoning Department. The Board will file the letters they got from the Peters.  The Board thanked the Peters for attending the meeting to clear this issue up.    

 

UPDATED ITEMS

APO – None

 

Zoning – Steve Wieber is on the agenda at the County Level. Citizens Meeting - Supervisor Keith Hibbard made a motion to support the Haven Township Sherburne County, Minnesota Resolution for no Change to Scenic District Rules for the Mississippi.  Supervisor Dennis Lietha seconded the motion.  The motion carried.  It was brought up that maybe at the annual meeting that the Township should budget and hire someone at the County Level to work with the Township in our Zoning issues.  MPCA & NPDES - This is a Federal requirement to have this permit for Haven Township.  Haven Township asked if this could be waived.  It can not be, so Haven Township can have the extension till January 20, 2007 to comply.  The Township needs to budget for this every year. 

 

Airport Update – There is no agreement with the City to purchase the Bauerly Brothers Busse Pit.

NEW BUSINESS

Luth LLC – Randy Luth asked for an Amendment to CUP for Hand Guns.  After discussion on this issue and talking with the Board, Mr. Luth and the Board decided to table this issue and find more information on the mystery CUP from the 70’s.  The Board was under the understanding that there was no CUP for the Gun Range ever.  This was back in the 40’s.  It was grandfathered in.  No permit was ever needed. Randy Luth will go back to Sherburne County Zoning and talk with them about this issue.  December Meeting – Randy Luth has withdrawn the CUP request for Hand Guns.  Ken & Mark Neeser were at the meeting with concerns about this issue.  They live directly behind, North of the Gun Club Range in Benton County.  They are ½ mile and ¾ mile from where the shooting is going on.  They have had bullets in their roofs, bullets in the siding on their garage and broken windows from bullets. They feel it is a big safety concern for them and their children.  They also feel that they can work something out with Randy Luth to have it a safe shooting range. They don’t want to shut the shooting range down.  Mike Kesch (Deer Haven) also lives near the shooting range.  He also has safety concerns. The County is working on this issue and will try to work out more safety options.  Supervisor LeRoy Pauley made a motion to renew the Liquor License for the Del-Tone Luth Gun Club.  Supervisor Ted Prom seconded the motion.  The motion carried.

Resolution for Board Investment Policy – Supervisor LeRoy Pauley made a motion to accept the Haven Township Sherburne County MN Investment Policy.  Supervisor Keith Hibbard seconded the motion.  The motion carried.

 

Record Retention Policy - Supervisor LeRoy Pauley made a motion to accept the Resolution for the Record Retention Policy.  Supervisor Ted Prom seconded the motion.  The motion carried.
