MINUTES OF THE HAVEN TOWN BOARD MEETING

January 22, 2007

 

The Haven Town Board met at the Haven Town Hall on Monday, January 22, 2007.  The meeting was called to order at 7:00 p.m. by Chairperson Eric Meyer.  Members present:  Eric Meyer, LeRoy Pauley, Keith Hibbard, Ted Prom, Mike Zniewski, David Meyers, and Tammy Schefers. 

 

APPROVAL OF AGENDA

Supervisor LeRoy Pauley made a motion to approve the agenda.  Supervisor Ted Prom seconded the motion.  The motion carried.

 

READING OF THE MINUTES

The minutes were set aside and will be approved at the February Meeting. 

 

BUILDING PERMITS

There was one building permit.

 

SHERBURNE COUNTY SHERIFF REPORT

The Deputy Sheriff gave the report for the month of December.  There were a total of 79 incidents.

Supervisor LeRoy Pauley made a motion to pay the outstanding bills.  Supervisor Ted Prom seconded the motion.  The motion carried. 

 

OLD BUSINESS

CUP Vesterra, LLC – They are still working with the Railroad and Teders property on this issue. 

 

Don Nelton – Still in litigation. 

 

Fire Department – There was a public meeting on January 16, 2007.  The whole Haven Township will stay in the Sauk Rapids Fire District.

 

Knife River Corporation – Expansion on the Busse Gravel Pit.  Conditional Use Permit Gravel Mining over 10,000 Cubic Yards.  Ron Klinker spoke about the Company wanting to increase the acres being mined.  Ron Klinker spoke about five main issues they were: 1. Hours of Operation 2. Dust Mitigation Plan 3. Water Table  4. Noise 

5. Flow of Water.  Ron Klinker went through the paper he handed out to the Board Members.  It was from the Planning Commission Public Hearing.  There were 35 Conditions.  The St. Cloud Airport also sent a letter.  After Ron Klinker was finished with his presentation, Chairman Eric Meyer took comments.  Supervisor Keith Hibbard had a letter for the board stating:  “We think the County is unwittingly discriminating by recommending denial on mining into the groundwater on the Stark Pit issue.  The Township has approved mining in the groundwater for nearly all applicants, and notes that no one objected when the DNR flooded a huge area just west of the Airport to attract wildlife.  We think this is more about money than ducks.  The City has a vested interest in devaluing land surrounding the Airport because they want to buy up to 1300 acres for Airport expansion. What better way to devalue gravel and rich land than to make mining half or more of it, off limits.  We note that the City/Airport has done nothing about its own open water, that practically touches the runway both ditch and ponds.  There are a numerous natural wetlands on and around the Airport.  A couple more holes won’t matter.  I have wetlands just south of the Airport and seldom see waterfowl using them.  A sterile gravel pit is even less attractive to wildlife such as ducks and geese.  Perhaps the County doesn’t realize that most of what’s left to mine at the Stark Pit is below the water table.  We think it would be unreasonable to ask Mr. Stark to leave his retirement in the ground, and note that it will only lead to litigation.” Joe Braun asked Supervisor Ted Prom if he does business with Bauerly Brother’s just for clarification.  Joe Braun also stated that the expansion of 40 more acres is not right.  Kathy Kosloski would like to have the opportunity to take the 35 conditions home and read them before a decision is made, then have a special meeting of a small group to talk about this.  Kathy Kosloski also has a video tape of the dust at the pit.  The two pits are already connected.  Any equipment can move though the pits. Jan Braun said there have been tons of meetings already. Jan Braun said the primary concern for her is to restrict the hours of operation and restrict the underwater mining.  Connie Johnson said the dust is terrible, if the dust could be controlled it would help.  Enclosed buildings would help.  Dave Tisen spoke about more traffic on the roads. Kathy Kosloski rescinded her request for another meeting.  After discussion on this issue, Supervisor LeRoy Pauley made a motion to move for positive comment and accept the 35 conditions that were presented by Ron Klinker (Bauerly Brother’s) tonight.  The Stock Pile area Map and Ground Water Flow Evaluation Map will go with to the County.  Supervisor Keith Hibbard seconded the motion.  The motion carried.  Chairman Eric Meyer opposed.         

 

UPDATED ITEMS

APO – None

 

Zoning – The Board talked about the Proposed Amendment on Subdivision in the Agricultural District.  After discussion on this issue Supervisor LeRoy Pauley made a motion to accept the Proposed Amendment on Subdivision in the Agricultural District.  Supervisor Keith Hibbard seconded the motion.  The motion carried.

NEW BUSINESS

River Issues – Saturday, March 10, 2007 – 10:15 a.m. at the Haven Township Hall there will be a legislative forum in Haven Township by Tarryl Clark.  The forum is River Issues.

The Board Members talked about how faxes are not acceptable for filing for a Supervisor Position for the Annual Elections.

 

Supervisor LeRoy Pauley made a motion to approve the Election Judges for the March 13, 2007 Township Election.  They are as follows:  Mike Zniewski, Penny Weihrauch, Rose Martinson, Diane Reed, Virginia Mezera, Robyn Meyer, and Jean Paulson.  Supervisor Ted Prom seconded the motion.  The motion carried.   

   

The Supervisors talked about going to the APO and Parks & Trails Meetings.

 

The Board of Audit Meeting will be held at 6:00 p.m. on Monday, February 26, 2007 with KDV before the regular meeting.    

 

The Board Members talked about the Notification of Adoption of Township General Retention Schedule.  After discussion on this issue Supervisor LeRoy Pauley made a motion to adopt the resolution of the Minnesota Townships General Records Retention Schedule.  Supervisor Keith Hibbard seconded the motion.  The motion carried.

 

Clean-up Day is scheduled for May 5, 2007.

 

Annual Meeting for the Sherburne County Association of Townships will be held at the Haven Township Hall on Wednesday, April 18, 2007 at 7:30 p.m.  Mike Zniewski will set up the Township Hall for this.

It was moved by Supervisor LeRoy Pauley, seconded by Supervisor Ted Prom to adjourn the meeting.  The motion carried, and the meeting was adjourned at 8:58 p.m.
